Northvane LLC ("ServiceTracked," "we," "our," "us")

This Acceptable Use Policy ("AUP") describes the conduct expected of all users of ServiceTracked. Violation may result in suspension, termination, and/or legal action.

By using ServiceTracked, you agree to comply with this AUP.

1. Lawful Use Only

You agree to use ServiceTracked only for lawful purposes. You will comply with all applicable laws and regulations in your jurisdiction, including:

  • Tax laws and reporting requirements
  • Consumer protection laws
  • Privacy and data protection laws (GDPR, CCPA, LFPDPPP, PIPEDA, etc.)
  • Employment laws (for businesses with employees)
  • Industry-specific regulations (HVAC licensing, pest control certification, electrical permits, etc.)

If you are uncertain whether a particular use is lawful, consult a qualified attorney before using the Service for that purpose.

2. Prohibited Service Categories

You may NOT use ServiceTracked to:

2.1 Illegal Services

  • Operate businesses that are illegal in your jurisdiction (regardless of legal status elsewhere)
  • Generate quotes or reports for prohibited goods/services (controlled substances, illegal weapons, etc.)
  • Facilitate trafficking in stolen goods or services

2.2 Fraudulent or Deceptive Services

  • Misrepresent yourself or your business
  • Provide false service descriptions to customers
  • Engage in price-gouging or fraud
  • Submit fake reviews about your own business
  • Create fake customer testimonials

2.3 Predatory or Harmful Services

  • Engage in services that physically harm customers or third parties
  • Use intimidation, coercion, or threats against customers
  • Discriminate against customers based on protected characteristics

2.4 Spam and Unsolicited Communications

  • Send unsolicited bulk communications (spam) to customers or non-customers
  • Send unsolicited SMS, email, or phone calls beyond legal compliance (CAN-SPAM, TCPA, GDPR)
  • Use ServiceTracked to harvest emails or phone numbers from third parties

2.5 Adult Content

  • Use ServiceTracked for businesses providing sexually explicit services
  • Submit sexually explicit images or audio recordings as content
  • Solicit customers via ServiceTracked for sexual services

3. Content Standards

Content you submit to ServiceTracked (voice memos, photos, text, customer information) must:

3.1 Be Truthful and Accurate

  • Reflect actual service work you provided
  • Not misrepresent the scope, quality, or pricing of services
  • Not fabricate customer information or interactions

3.2 Not Be Harmful

You may NOT submit:

  • Threats of violence against anyone
  • Hate speech, slurs, or discriminatory language
  • Sexually explicit content
  • Content depicting violence, abuse, or self-harm
  • Content harming minors in any way
  • Bullying, harassment, or stalking content
  • Defamation of third parties (false statements about competitors, etc.)

3.3 Not Infringe IP

  • You may not submit copyrighted material you do not own
  • Quotes/reports must be your original work product
  • You may not use trademarks of competitors or unrelated businesses

3.4 Respect Customer Privacy

  • You may only submit customer information you have lawful authority to process
  • Customer photos require consent or comply with applicable law
  • Voice recordings of customers require consent in jurisdictions where required (some US states are one-party consent, others are two-party)

If you collect customer data, you must:

  • Notify customers about data processing (typically via a privacy notice during service intake)
  • Process data lawfully (relevant under GDPR, CCPA, LFPDPPP, etc.)
  • Honor customer requests regarding their data (access, correction, deletion)

ServiceTracked is your Data Processor; you are the Data Controller for customer data.

4. Network and System Use

You may NOT:

4.1 Disrupt the Service

  • Send disproportionate or abusive load to the Service (overwhelming requests, denial of service)
  • Use the Service in ways that interfere with other users
  • Attempt to disrupt, hack, or compromise system security

4.2 Reverse-Engineer or Decompile

  • Decompile, disassemble, or attempt to discover source code
  • Use bots or scrapers to extract data at scale
  • Modify or create derivative works of ServiceTracked technology

4.3 Resell or Sublicense

  • You may not resell ServiceTracked subscriptions to others as your own service
  • You may not sublicense access to your subscription beyond the seats you have paid for
  • Multi-tenant use ("White-labeling") is not permitted

4.4 Bypass Security

  • You may not bypass authentication, rate limits, or access controls
  • You may not use the API or scraping to perform high-volume operations beyond your subscription tier
  • You may not share account credentials with non-authorized users

4.5 Test Systems Without Permission

  • You may not penetration-test or security-scan ServiceTracked infrastructure without express written permission
  • Reporting security vulnerabilities responsibly via security@servicetracked.com is encouraged

5. Customer Communication

5.1 Outbound Communications

When ServiceTracked sends communications to your customers on your behalf (quotes, reports, follow-ups):

  • You must have a legitimate business relationship with the customer
  • You must comply with CAN-SPAM (US), GDPR, and other applicable laws
  • You must honor unsubscribe requests within 10 business days
  • You must not send unsolicited bulk communications

5.2 Customer Disputes

If a customer disputes a service, charge, or our handling of their data:

  • Cooperate with customer in good faith to resolve disputes
  • Do not retaliate against customers (negative reviews of customers, public disclosure of their info, etc.)
  • Do not use ServiceTracked to harass customers

If a customer files a complaint with us, we may:

  • Contact you to understand the issue
  • Help mediate disputes
  • Suspend service if violations are confirmed

6. Identity and Authentication

6.1 Account Security

  • Use strong passwords (minimum 8 characters, mixed case, numbers/symbols)
  • Enable multi-factor authentication if available
  • Keep your credentials confidential
  • Notify us immediately if you suspect unauthorized account access

6.2 Identity Misrepresentation

You may NOT:

  • Create accounts using fake names, fake business names, or false identities
  • Impersonate other businesses, employees, or individuals
  • Use ServiceTracked to create the appearance of being someone you are not

We may verify your identity at any time, including via:

  • Email or phone verification
  • Government-issued ID upload (Stripe Verified Tier or higher)
  • Business registration documents
  • Tax ID verification

7. Multi-Account Restrictions

  • Each business operation should have ONE active ServiceTracked subscription
  • Operating multiple subscriptions for the same business to circumvent tier limits is prohibited
  • Creating accounts to evade prior suspensions is prohibited
  • One person operating multiple distinct businesses may have multiple subscriptions (one per business)

If you legitimately operate multiple businesses (parent company + subsidiaries, etc.), contact us at support@servicetracked.com to discuss proper multi-account configuration.

8. Affiliate Program (If You Participate)

If you participate in the ServiceTracked affiliate or referral program:

  • Promote ServiceTracked truthfully and accurately
  • Do not make misleading claims about features, results, or earnings
  • Do not bid on ServiceTracked brand keywords in paid search
  • Disclose your affiliate relationship when promoting (per FTC guidelines)
  • Do not engage in spamming, hacking, or other harmful activities to drive referrals
  • Do not refer accounts you do not have permission to refer

Violations may result in commission forfeiture and termination from the affiliate program.

9. AI Use

9.1 Your Responsibilities

  • Do not submit content that contains personal information of third parties without their consent
  • Do not submit content explicitly designed to trick or manipulate the AI
  • Do not use AI-generated content for purposes that violate this AUP
  • Review and edit AI-generated content before sending to customers; you are responsible for accuracy

9.2 Our Responsibilities

  • AI processing complies with privacy laws and data protection agreements
  • Our AI providers (OpenAI, Anthropic) are bound by confidentiality
  • AI outputs are not guaranteed to be perfect; review before use

10. Reporting Violations

If you observe violations of this AUP by another ServiceTracked user, please report them:

  • Email: abuse@servicetracked.com
  • Subject Line: "AUP Violation Report - [Brief Description]"
  • Include: The specific behavior you observed, where you observed it, any supporting evidence (screenshots, dates, etc.), your account email

Reports are reviewed within 5 business days. We may follow up for additional information.

11. Enforcement and Consequences

Violations of this AUP may result in:

11.1 Warning

For minor or first-time violations, we may issue a written warning explaining the violation and required corrective action.

11.2 Account Restrictions

We may temporarily limit certain features:

  • Email sending limits
  • API rate limits
  • Multi-user functionality

11.3 Suspension

For serious or repeated violations, we may suspend your account:

  • Account access blocked
  • Subscription billing paused
  • Data preserved during suspension

11.4 Termination

For severe violations (fraud, illegal use, repeated suspensions), we may terminate your account:

  • All data deleted (subject to legal retention requirements)
  • Refunds processed per our Refund Policy
  • Future account creation restricted
  • Legal action may be pursued where applicable

11.5 Legal Action

Severe violations (fraud, theft, criminal activity) may also be referred to law enforcement.

We reserve the right to take any action we deem necessary to protect ServiceTracked, our users, and third parties.

12. Investigation and Cooperation

We may investigate suspected violations of this AUP by:

  • Reviewing account activity
  • Examining content submitted (with appropriate privacy protections)
  • Interviewing involved parties
  • Cooperating with law enforcement when legally required

You agree to cooperate with reasonable investigation requests.

We will provide reasonable notice and opportunity to respond before taking severe action, except in cases of urgent safety or legal concerns.

13. Appeals

If you believe we have incorrectly applied this AUP to your account:

  • Email legal@servicetracked.com with subject "AUP Appeal"
  • Provide specific facts and evidence supporting your appeal
  • We will review within 10 business days
  • We may reverse, modify, or uphold our original decision

Appeals decisions are final. We do not have a multi-tiered appeals process; one fair review is what we provide.

14. Changes to This Policy

We may update this Policy as needed to address new issues, technologies, or legal requirements. Material changes will be announced at least 60 days in advance.

15. Contact

We respond to AUP-related inquiries within 5 business days.

17. Acknowledgment

By using ServiceTracked, you acknowledge that you have read, understood, and agree to comply with this Acceptable Use Policy.

You understand that ServiceTracked monitors for violations and may take enforcement action including suspension or termination of your account.

This Acceptable Use Policy is effective as of the date shown above.
